Terms of Service for the CO2e Calculator
Version 1.0 dated 29 April 2024
PLEASE READ ALL OF THE FOLLOWING TERMS OF SERVICE (the “Terms”) CAREFULLY BEFORE USING THE SERVICE.
These Terms set out the legal terms and conditions governing the use of the CO2e calculator, its platform, and any other online or mobile version of the CO2e calculator by Fonden AM-Lab Danmark (CVR 39144344) (“AM Hub”, “we”, “our”) (collectively, the “Service”).
By using the CO2e calculator developed by AM Hub in any manner, the tool user acknowledges that they have read and agree to be bound by these Terms.
1 Description of the Service
AM Hub provides a web tool for calculating the difference in CO2e emissions of a product over its entire life cycle when produced using a conventional versus an additive manufacturing process.
The calculation is an estimate for comparison purposes, based on aggregated data from the Ecoinvent database and user input.
2 Term and termination
The tool user is granted access to the Service through the AM Hub sustainability & engagement package. Access to the Service is governed by the terms of the package.
If AM Hub has reasonable grounds to suspect that the tool user is in breach of these Terms, we reserve the right to terminate and refuse any and all current or future use of the Service. Such termination may be made as a preventive measure at AM Hub’s sole discretion, and we shall not be liable for any direct or indirect consequences for the tool user in relation to such termination.
In addition, AM Hub reserves the right to terminate the Service in general, or any part thereof, at any time, in which case we will provide notice within a reasonable time.
3 Obligations and conduct of the tool user
3.1 Licence to use the Service
AM Hub grants the tool user a non-exclusive, non-transferable, limited, and revocable licence to use the Service in accordance with these Terms, for the purpose of creating commercial or academic studies and reports for internal or external use. For the avoidance of doubt, no rights are sold or transferred to the tool user.
3.2 Personal account
The tool user’s account is personal, and the tool user is responsible for all activities that occur under the account.
The account details must be kept confidential and may not be shared internally or externally. The tool user must immediately notify AM Hub of any unauthorised use of the Service under the tool user’s account.
AM Hub reserves the right to impose charges for any unauthorised use of the Service based on such use.
3.3 Restricted actions
The tool user warrants that they will not:
- use, copy, adapt, change, translate, modify, sub-license, sell, or distribute all or any portion of the Service other than for the purposes expressly licensed in these Terms or otherwise expressly required by mandatory law;
- reproduce, disseminate, or publicly display the Service, or any portion or derivation thereof, other than as licensed in these Terms;
- grant any third party any rights regarding the Service (e.g., a sub-licensing right);
- publish or make available to others derivative databases or datasets, or database-like products, using all or any portion of the Service or any derivation thereof;
- prepare extracts of the Service, or any portion or derivation thereof;
- use the Service, or any portion or derivation thereof, in any other product or service;
- use the Service, or any portion or derivation thereof, to provide any service for third parties except for the studies and reports as licensed in these Terms;
- use web crawlers or any other types of software or hardware technology (e.g., AI or machine learning) to automatically download, export, or index data from the Service;
- reverse engineer, decompile, or otherwise disassemble the Service to derive data therefrom;
- disclose the login details for access to the Service to any third party, or allow third parties to access the Service;
- assign the licensed rights to any third party;
- remove or alter any symbols or legends indicating any intellectual property rights or attributions to sources;
- publish or otherwise disclose, for internal or external use by third parties, the calculated results enabling the viewer to compare and/or assess goods and services for any purchase, lease, rent, or similar actions (e.g., ecological footprints for e-shop listings, restaurant menu cards, or official declarations on goods).
3.4 User-submitted data
The tool user retains ownership of any data submitted to the Service. However, the tool user grants AM Hub a non-exclusive, transferable, sub-licensable, perpetual, irrevocable, and royalty-free licence to use, reproduce, modify, distribute, publish, or otherwise process submitted data without any further consent, notice, or compensation to the tool user. This licence shall survive any termination of these Terms.
4 Intellectual property rights
All content provided in the Service, including but not limited to information, data, results, text, images, designs, code, and algorithms, is the intellectual property of AM Hub and its licensors and is protected by national and international laws such as copyright laws and database rights. AM Hub and its licensors retain all intellectual property rights in the Service.
5 Third-party elements
The tool user acknowledges that parts of the Service may contain elements provided by third parties, including but not limited to APIs and other types of services or content.
The tool user’s interaction with such third-party elements is governed by the applicable terms and privacy policies of the relevant third party.
AM Hub does not endorse, and accepts no liability for, third-party elements that may be made available through the Service.
6 Disclaimers
6.1 Warranty disclaimer
The Service is provided on an “as is” and “as available” basis. AM Hub will strive to keep the Service available and free of significant defects.
AM Hub expressly disclaims all representations and warranties related to the Service, whether express or implied, including but not limited to availability, fitness for any particular purpose, and the accuracy, completeness, or correctness of data and results.
6.2 Validity of data and results in the Service
AM Hub obtains data for the Service from professional third parties that are known to be trustworthy data providers. However, AM Hub does not guarantee the validity, accuracy, completeness, or results of such third-party data or any data submitted by the tool user.
The tool user acknowledges that any use of the Service is at their own risk. It is the sole responsibility of the tool user to evaluate the accuracy and applicability of any results before use.
6.3 The Service is for informational purposes only
The Service and the results provided are for informational purposes only and shall not be construed as an express or implied promise, guarantee, or binding indication by AM Hub or its licensors as to any real-world outcome.
7 Limitation of liability
AM Hub and its licensors shall in no event be liable for any direct or indirect damages suffered by the tool user or any third parties in relation to the Service, including but not limited to consequential damages, loss of income or profits, loss of or damage to data, business, or reputation, irrespective of whether due to human or technical error or otherwise.
The tool user’s sole remedy for any issues or dissatisfaction with the Service is to discontinue using the Service.
In any event, the aggregate financial liability for all claims related to the Service shall not exceed the total amount of payments received by AM Hub in the 12-month period preceding the event that gave rise to the claim.
8 Indemnification
The tool user agrees to indemnify, defend, and hold AM Hub and its licensors harmless from and against all costs, expenses, damages, losses, or liabilities arising out of, or in connection with, the tool user’s breach of these Terms.
This indemnification shall survive any termination of these Terms.
9 General provisions
9.1 Amendments to the Service
AM Hub is constantly working to improve the Service and may from time to time make changes, enhancements, additions, or suspensions to any parts of the Service. Major amendments to the Service will be communicated to the tool user via the Service or by email.
9.2 Amendments to these Terms
AM Hub reserves the right to amend these Terms from time to time. Any material changes will be communicated to the tool user via the Service or by email.
Continued use of the Service after the amended terms have entered into effect shall constitute the tool user’s acceptance of the amended terms.
The latest Terms are always available on our website.
9.3 Beneficiary rights
AM Hub’s licensors shall have beneficiary rights regarding the enforcement of the restrictions pursuant to paragraph 3.3 above, for the purpose of protecting the licensors’ proprietary data.
9.4 Breach of these Terms
Breach of these Terms may result in immediate termination of access to the Service, as well as any legal actions that AM Hub or its licensors deem appropriate.
9.5 Governing law and jurisdiction
Any disputes or claims arising out of or in connection with the Service shall be exclusively governed by and construed in accordance with the laws of Denmark, notwithstanding any conflict of law provisions. The courts of Denmark shall have sole and exclusive jurisdiction to resolve any such disputes or claims.
10 Data protection
The tool user accepts that AM Hub may collect, store, and process personal data submitted through the Service in accordance with our Privacy Policy.
